Leven in een Spaanse soap

Zo af en toe maak je toch wat mee, zoals vorige week. Een vriendin van ons heeft een tijdje geleden haar relatie op de klippen zien lopen. Een paar weken later verloor ze haar baan en daarna besloot ze (uiteraard na goed overleg) voorlopig haar intrek te nemen in onze extra kamer. De hele huisraad werd verhuist en nu staat ons balkon vol met spullen. Van extra messen en vorken tot een opblaasbare kano.

Ach ja, als we op die manier iemand kunnen helpen is dat natuurlijk geen probleem. Deze huisgenoot ging echter deze week op een kleine zeilvakantie. Lekker varen met een groot jacht. Ze zou maandag weer terug naar huis keren, maar lijkt nu van de aardbodem verdwenen.

Ammer, Bar, Lucas en ErwinOndertussen kwamen een aantal vrienden uit Nederland op bezoek in het zuiden. Gezellig bijna iedere dag naar het zuiden om te genieten van het lekkere weer, de tapas, te spelen met de kleine en iedereen weer even zien. Erg geslaagd en na dit bezoek kan ik in ieder geval zeggen dat de uitdrukking ‘Lekker weer‘ een geheel nieuwe betekenis heeft gekregen.

Tegelijkertijd hebben andere vrienden hier in Las Palmas net een huis gekocht. Dat moet gevierd worden, maar wanneer… Dit hebben we maar even uitgesteld.

Ook tegelijkertijd is een andere vriendin op bezoek uit Indonesië. Haar relatie loopt ook op de klippen en een paar dagen verblijft ze in de kamer van de meid die toch aan het zeilen is, met haar hele hebben en houden in onze woonkamer (gelukkig niet veel).

Al met al een erg drukke week dus. Wel erg leuk om al de hectiek mee te maken en dat na een tijdje alles weer lekker zoals het oude is. Misschien is het toch helemaal niet zo’n slecht idee om eens verder uit te zoeken of we hier onze entrepreneur-schap op een of andere manier kunnen uitbuiten met een huisje of excursies voor vakantiegangers.

Agrarische trekjes

Dankzij een vriend die zich eigenlijk met zijn scriptie had moeten bezighouden ben ik begonnen met het spelen van FarmVille. Een spelletje dat via de facebook site gespeeld kan worden en waarbij je moet ploegen, zaaien, oogsten en verkopen. Hoogst eenvoudig maar toch best leuk om te spelen.

Helaas is het hier op het vakantie eiland geen goed idee om verslaaft te raken aan een ‘binnenactiviteit’. Nu kijken hoe ik van mijn FarmVille verslaving ga afkomen.

Agualand

Agualand!A lot of years ago (I think I was 6 or 7 years old at the time) I visited agualand again. Agualand is a waterpark on the south of the island. I somehow remember it was a nice park, but it was a lot smaller then I remembered. I think all the attractions were exactly the same as almost 30 years ago. The only thing I did not remember from my previous visit as a little boy were the burning hot stones you needed to walk across to get to the slides. Also the park closes very early. Around 6 o clock the visitors were asked to leave the park.

It was a nice visit and I was happy I brought some sunscreen factor 50, because there was very little shadow in the park. The entrance fee was quite high, 20 euros if you provide a discount ticket worth 6 euros. These discount tickets you can get everywhere, for example in a lot of supermarkets. The part is fun and it is worth a visit. Be sure to bring flip flops that can get wet! You need these to walk to the slides and not burn your feet.

Telefoontje opwaarderen?

Op de Canarische eilanden betaal je een aangepast belasting tarief. Een tarief speciaal voor landen aan de uiterste grens van Europa. Het lage tarief is bedoeld om de locale economie een beetje te steunen. Gevolg hiervan is een aanmerkelijke lagere prijs voor drank, sigaretten, benzine, en eigenlijk van alles.

Het makkelijkst merk je het bij het opwaarderen van je telefoon. Gisteren heb ik mijn telefoon opgewaardeerd met 20 euro, en ik kreeg netjes 23 euro bijgeschreven. Toch leuk meegenomen, die 3 euros. Zou het echter ook werken met een buitenlandse (Nederlandse telefoon), wellicht is het dan een idee een websiteje te maken om telefoons op te waarderen en dan de winst te delen…

The sky is not the limit

Footprint!Everywhere in the world people are celebrating. Celebrating 40 years of human curiosity. 40 years in which we have proven to ourselves that the sky is not the limit.

What is sometimes used as the symbol for these 40 years is a picture of the first footstep on the surface of the moon. Recently I´ve seen this picture pop up on lots of places, but this picture bothers me. In my opinion there are some strange things in this picture.

First of all there is the shadow near the footprint. Normally if you have a footprint the shadow will fall inside the print, because the footprint is inside the dirt. In this picture the footprint is the cause of the shadow, which makes it seem the footprint is on top of the dirt.

Second, the footprint seems a little to perfect. It does not look like a footprint you can make in really dry sand. It also does not look like a footprint you can make on a really hard surface. It looks like a footprint made in sand that can easily be shaped, and that contains enough water or liquid to stay in the shape of the print.

But maybe I´m all wrong of course. The picture we see does not need to be true as long as the idea behind the picture is. There are no limits to what we are capable of. We can place a footprint on our moon and for sure we can do the same in whatever place we desire. Together we can achieve greatness.

Scotland, here we come!

Scotland!Our planned vacation time is coming closer and closer and this your we are sticking to Europe. Our plan is to pass by Spain and Holland for a few days each and then on the 30th continue to Edinburgh, Scotland. In Scotland we plan to explore the country in about a week. Just to get a feel of things. Of course we’ll stop by Lock Ness and see if we are lucky and catch a glimpse of the ancient monster.

After Scotland we return to Holland where Ana will stay only a few days and I will stat a little over a week. Enough time to catch up and visit friends and family.

De juridische details

De website van datepad (relatiebemiddeling) heeft sinds 2008 iets aan content dat refereert aan datepad als relatiebemiddelings website. (datepad web versie in 2008) De url was echter al geregistreerd in 2004 door een domeinnamenboer (http://web.archive.org/web/*/http://datepad.com).

Een trademark zoekopdracht (http://www.uspto.gov/) resulteert in de volgende gegevens (Trademark Electronic Search System (TESS)):

Het trademark is aangevraagd in 2008 en toegekend in 2009 (19 mei). Een maandje later stuurt de eigenaar me een mail om een link te verzoeken.

Mijn DatePad bestaat sinds 2001 (zie readme.txt in de allereerste distributie versie). Onze ‘klanten’ zijn verschillend, en de kans op verwarring tussen de twee sites is nagenoeg nihil. Mijn site biedt gratis software aan om een agenda bij te houden. De andere site is bedoeld voor relatiebemiddeling. Derhalve maak ik me niet meer druk. Helemaal niet na het gratis advies via de avvo site.

Verder komt er bij deze hele kwestie natuurlijk ook nog het internationale aspect kijken. Het feit dat zij in de USA zijn gevestigd en ik hier in het verre europa, zal de boel niet vereenvoudigen.

Mijn reply aan Shawn (de ‘President and CEO’ van de andere Datepad):

After evaluating your email and reviewing the search results in Google I have to conclude that there is almost no posibility that your clients or mine will get confused by the search results as it is clearly indicated your datepad is a site about dating, and mine is software for keeping a calendar.

I think adding a link to refer to your dating site will not be necesary, because it is not something the visitors to my website will be interested in.

Hopende dat hiermee de kous af is.

Ook volgens TheLaw.com hem ik niet veel te duchten, alhoewel dit toch een iets minder profesioneel antwoord is:

First of all, I have no idea if this newly registered site really does own any rights. Second, when you file a trademark, you must make representations of not knowing that there is prior usage. Considering you have been using that name for your software for 8 years and all this person did was use Google to find you, I’d have to say their trademark search was lousy. It would seem to me that if all he wants is a link to their site, they probably don’t have the rights that they say they do. If you challenge their rights and state the above to them… might they be afraid that you can challenge their trademark? I can’t tell you what to do but my feeling is that they aren’t looking for a lawsuit any more than you and they probably know they likely do not have a case. These are just my thoughts.
